Since when did the Constitution mean anything to these people? Why don't we say this, as long as they're stripping the Bill of Rights, we'll reciprocally strip the parts of the Constitution endowing the Executive with any power.

ADDINGTON: Sir, perhaps the best that can be said is that the vice president belongs neither to the executive nor to the legislative branch, but is attached by the constitution to the latter.
So according to Addington, the Vice President is his own branch of government, or part of the Executive and the Legislative, but not, well sort of. This hack certainly can do the legal dance.

It's really not this complicated. The constitution starts with Article 1 defining the legislative branch. Section 1 defines both houses, Section 2 defines the house and Section 3 defines the senate. The first time Vice President is mentioned is right there in section 3.
Obviously, this legal dance is all about protecting Addington's Job and VP Dick Cheney.

Well, yeah :P. But the point is to be explicit. That's the best way to get around loopholes IMO. (given you can't have everyone just be reasonable and uncorrupt)

Sec 1 says "All legislative Powers herein granted shall be vested in a Congress of the United States, which shall consist of a Senate and House of Representatives." and then in sec 3, the Vice President is defined to be part of the Senate: "The Vice President of the United States shall be President of the Senate, but shall have no Vote, unless they be equally divided"
He's part of the legislative branch and cannot claim Executive Privilege

yes ... the constitution stands in the way for them to further their empire. I wonder how many of this cast of characters we'll see again under McCain or Obama. Hopefully Obama will have the guts to try these people as felons and war criminals.

It is about human beings that have been illegally harmed. Call it a witch hunt, but all of these stupid hearings are necessary to define terms and legalities which the current administration is using to weasel out of subpenas to congressional hearings. They can't even come straight and testify in front of congress and present why they did certain things. Watch the video where John Yoo wastes at least 7 1/2 minutes dancing around the term "implemented". They all know they are playing games.

But things have been changed in the constitution since 1961.
Clearly the constitution (sec 3) says "The Vice President of the United States shall be President of the Senate" and thus belongs to the legislative branch. He only becomes part of the executive branch when taking over the President's job according to the 25th amendment.
You would think Dick Cheney should not be able to claim "Executive Priviledge."
